A civil and/or criminal offence, fraud is defined as wrongful or criminal deception intended to result in either financial gain, or to cause financial loss, or risk of loss, to others. Below are some common examples of fraud that occur frequently across the UK:

●     Making a false claim for their own financial gain or to cause a loss, or risk of financial loss, to another party or individual. This will typically include providing false information/details on a mortgage or credit card application.

●     Failure to disclose legally bound information for an individual gain, or as an attempt to cause loss, or risk of loss, to another party or individual.

●     Abusing responsibility/power to protect another person or party’s financial interests for the individual’s gain, or to cause loss, or risk of loss, to another party or individual.

●     Knowingly participating with a business or individual that intends to commit fraud.

What To Do If Charged With Fraud?

First things first; lawyer up. No matter how innocent you may think, or even categorically know you are, the counsel, experience and expertise of a proven defence solicitor are essential in providing you with the best legal advice and representation to restore your reputation. After all, fraud is a serious allegation, and if you truly are innocent, hiring professional legal representation will provide you with the best possible chance of clearing your name. Below are a few key points to consider if you have recently been accused of fraud and are seeking legal representation:

●     Never admit guilt, or communicate openly with the police/authorities, without the presence of legal representation.

●     Gather and present any and all evidence you may have and pass it on to your solicitor. This will provide them with the necessary information to investigate and construct a defence based on the facts.

●     Do not allow the police to conduct any searches of your home or workplace until you have contacted your solicitor, as they will ensure the police have the appropriate, valid warrant.

In short; the sooner you hire effective legal consultation and representation, the better. Legal representation is necessary in order to protect your own interests and your reputation as an individual and employee, and at Lefevre Litigation, our expert legal team is here to help and advise you at every stage of your case, providing you with the best legal defence team across the whole of Aberdeen.
